Silva came down under to visit her friend, was charged for drug importation in Melbourne airport last week. Sniffer dog, swab and presumptive test shown positive results indicating three 800g Nestle ice tea of her were narcotic.
She was held in custody for five days before her charge was withdrawn after the Federal Police Forensic team analyzed the 'ingredient' which was genuine lemon flavoured tea powder.
She is paid with $5000 for ordeal. No one approaches and apologize for the false arrest after she was released. She would like to raise responsiveness from the Custom that this is a mistake that should not happen to anyone.
She described the custody experience was terrible and she is always in fear that she would be locked up again. She was locked up with others serious offenders in the cell and hardly get sleeps all time.
Silva is a wedding planner and runs family business in Phillipines, she was in shocked of the arrest against her, despite never taking drugs in her life.
A statement from Customs said the authority would write to Ms Silva "to personally express its regrets".
"Customs and Border Protection will assess its testing procedures in light of this case to see whether any improvements to presumptive testing are possible," the statement said.
Comment was being sought from the iced tea manufacturer Nestle.
